Allsteadt Result

This Trumball County case involves a medical malpractice claim of wrongful death of a 35 year old male.  Specifically, the decedent’s wife/Plaintiff alleges the result of failure to appropriately and properly diagnose and supervise her husband’s medical care lead to his untimely death.  An autopsy was performed, and the cause of death was listed as acute bilateral pulmonary thromboembolism due to probable deep venous thrombosis and stasis.

The Affidavit of Merit signed by Plaintiff’s expert, and filed with the Complaint, simply states that Defendants failed to consider deep vein thrombosis and that that failure lead to the development of pulmonary embolism and death.  Defendants’ experts opined that Defendants did not fall below the standard of care and further argued that the decedent’s fatal pulmonary embolism could not have been predicted.

After jury deliberations, the jury returned a defense verdict.
