Hospital Found Not Liable
POLING attorney, Frederick A. Sewards, successfully argued an appeal before the 5th
District Court of Appeal of Ohio on behalf of a hospital client. The Plaintiff had entered
into a settlement and release of a co-Defendant physician and Mr. Sewards
successfully moved for judgment in favor of the hospital on the grounds that the
settlement and release of the co-Defendant physician extinguished the liability of the
hospital. The Plaintiff hotly contested this issue as they wish to pursue the hospital for
further damages. The trial court granted Mr. Sewards’ motion for summary judgment.
The Plaintiff appealed to the 5th District Court of Appeals which, following argument by
counsel, overruled the Plaintiff’s appeal and sustained the summary judgment obtained
by Mr. Sewards.
