POLING Obtains a Verdict for the Defense in One Hour
Brant Poling and Zachary Hoover obtained a defense verdict in the Montgomery County Court of Common Pleas in a case involving an alleged failure to inform the patient of a broken spinal cord stimulator lead that was retained in the patient’s back following a revision surgery.
The defense was able to demonstrate the physician complied with the standard of care in that the patient was informed of the retained lead on multiple occasions and the patient’s husband, who was the patient’s legal representative at the hospital, was also informed of the retained stimulator lead post-operatively. The jury returned a verdict in favor of the defense within one hour.
